Royal Society of Chemistry publication quotes Dr. Richard Chinn on patent claim construction

Dr. Richard Chinn offered an experienced patent law perspective this week in an article in Chemistry World, a publication of the Royal Society of Chemistry.

The article focuses on computer-aided development of alternative synthesis routes for important molecules in potential treatments for COVID-19. Such analysis could have the potential to greatly increase global ability to provide active ingredients in large amounts. If demand increases suddenly for a certain compound, for example to be used in a treatment during a pandemic, then multiple synthesis routes starting from different source materials may bolster supply.

In proposing new pathways for drug production, the software may attempt to circumvent patent-protected methods. Still, patent coverage may sometimes involve complex analysis.

“Patent claim interpretation ... is based on the ordinary meaning of the claim terms, viewed in light of the description in the patent specification and arguments made before the patent office,” explained Dr. Chinn. Because patent claim coverage may be broader or narrower than it first appears, Dr. Chinn emphasized the need for experienced analysis before drawing any conclusions on the scope of coverage for any particular patent.
